1. Acceptance of Terms

By accessing or using AIClean ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

AIClean provides an AI metadata cleaning service that:

• Detects AI tool signatures in video and image files
• Removes or modifies EXIF, XMP, and IPTC metadata
• Simulates camera profiles for authenticity
• Provides API access for developers

3. User Accounts

3.1 Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Acceptable Use Policy

4.1 Permitted Use

You may use the Service to:

• Clean metadata from your own content
• Process content you have legal rights to modify
• Protect your privacy and creative work

4.2 Prohibited Use

You may NOT use the Service to:

• Process content you do not own or have rights to
• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious files or malware
• Attempt to bypass rate limits or security measures
• Reverse engineer or copy our Service
• Use the Service for illegal activities
• Harass, abuse, or harm others
• Distribute spam or unsolicited content

5. Subscription Plans and Payments

5.1 Plans

We offer multiple subscription plans:

• Free: 5 files per month, 20MB max file size
• Starter: $9/month, 50 files, 50MB max
• Smart: $29/month, 200 files, 100MB max
• Pro: $99/month, 500 files, 200MB max

5.2 Billing

• Subscriptions are billed monthly in advance
• Payments are processed securely through Stripe
• All fees are in USD unless otherwise stated
• Unused credits do not roll over to the next month

5.3 Refunds

We offer refunds under the following conditions:

• Service outage lasting more than 24 hours
• Technical issues preventing service use
• Billing errors

Refund requests must be submitted within 7 days of the charge. Contact support@cleanaiexif.com for refund requests.

5.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.

6. Content and Intellectual Property

6.1 Your Content

• You retain all rights to your uploaded files
• We do not claim ownership of your content
• Files are automatically deleted after 24 hours
• We do not use your files for training or any other purpose

6.2 Our Service

• AIClean and all related trademarks are our property
• Our software, algorithms, and infrastructure are protected by copyright
• You may not copy, modify, or reverse engineer our Service

7. API Usage

If you use our API:

• You must authenticate using valid API keys
• Rate limits apply based on your subscription plan
• You must not abuse or overload our infrastructure
• API keys must be kept secure and not shared
• We may revoke API access for violations

8. Service Availability

We strive to provide reliable service, but:

• We do not guarantee 100% uptime
• Maintenance may cause temporary interruptions
• We are not liable for service disruptions
• We may modify or discontinue features with notice

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The Service will be error-free or uninterrupted
• All metadata will be successfully removed
• Files will be processed without quality loss
• The Service will meet your specific requirements

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Loss of data or files
• Loss of profits or revenue
• Indirect, incidental, or consequential damages
• Damages exceeding the amount you paid in the last 12 months

10. Indemnification

You agree to indemnify and hold harmless AIClean, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you upload or process

11. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AIClean operates, without regard to its conflict of law provisions.

13. Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service:

• You agree to first attempt to resolve the dispute informally by contacting us
• If informal resolution fails, disputes will be resolved through binding arbitration
• You waive your right to participate in class action lawsuits

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIClean regarding the use of the Service.
